Terms and Conditions for host-c.com

These terms and conditions (“Agreement”) set forth the general terms and conditions governing your use of the host-c.com website (“Website” or “Service”) and any related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you”, or “your”) and HOST-C NETWORK EOOD (“HOST-C NETWORK EOOD”, “we”, “us”, or “our”).

If you are entering this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement. If you do not have such authority, or if you do not agree to the terms of this Agreement, you may not access or use the Website or Services. By using the Website and Services, you confirm that you have read, understood, and agree to be bound by this Agreement.

This Agreement constitutes a legally binding contract, even though it is electronic and not physically signed.

1. Accounts and Membership

You must be at least 18 years old to use our Website and Services. By creating an account, you warrant that the information provided is accurate and complete.

You are responsible for maintaining account security and for all activity conducted under your account. You must notify us immediately of any unauthorized access. We are not liable for any damages resulting from your failure to maintain account security.

We reserve the right to suspend, disable, or delete accounts that violate this Agreement or harm our reputation. Deleted accounts may not be re-registered. We may block your email or IP address to prevent re-registration.


2. Billing and Payments

You agree to pay all fees associated with your Services according to the pricing and billing terms in effect at the time of purchase.

If auto-renewal is enabled, your payment method will be charged automatically at the start of each renewal period.

We may request additional verification for high-risk transactions, including government-issued identification and/or proof of card ownership.

We reserve the right to modify product pricing at any time and to refuse or cancel orders at our discretion.


3. Accuracy of Information

We make efforts to ensure accuracy but may occasionally publish information containing typographical errors or inaccuracies. We reserve the right to correct such information at any time, including after an order is submitted.


4. Third-Party Services

Use of third-party services is governed solely by their respective terms. We are not responsible for the behavior, content, or data handling practices of third-party service providers.

By enabling such services, you permit HOST-C NETWORK EOOD to share necessary data with them.


5. Links to Other Resources

Links to external websites do not imply endorsement. We are not responsible for the content, security, or practices of external sites. Accessing them is at your own risk.


6. Prohibited Uses

You agree not to use the Website or Services to:

  • Violate laws or regulations

  • Engage in abusive, defamatory, discriminatory, or harmful behavior

  • Submit false information

  • Spread malicious code

  • Perform unauthorized access attempts

  • Spam, phish, scrape, or crawl

  • Interfere with service functionality or security

  • Engage in obscene or immoral activity

Violation may result in immediate termination of service.


7. Intellectual Property Rights

All Website content is protected by intellectual property laws. You may not reproduce or redistribute any materials without our written permission.


8. Disclaimer of Warranty

Services are provided “as is” and “as available.”
We disclaim all warranties, express or implied. Use of the Services is at your own risk.


9. Limitation of Liability

To the fullest extent permitted by law, HOST-C NETWORK EOOD shall not be liable for indirect, incidental, punitive, or consequential damages. Our total liability shall not exceed the amount paid by you in the month preceding the event giving rise to the claim.


10. Indemnification

You agree to indemnify and hold HOST-C NETWORK EOOD harmless from any claims resulting from your use of the Website or Services, your content, or your misconduct.


11. Severability

If any part of this Agreement is found unenforceable, the remainder will remain in full effect.


12. Dispute Resolution

This Agreement is governed by the laws of Bulgaria. All disputes must be resolved exclusively in the courts located in Bulgaria.

You waive the right to a jury trial.
The UN Convention on Contracts for the International Sale of Goods does not apply.


13. Assignment

You may not transfer your rights or obligations under this Agreement without our written consent.

We may assign our rights and obligations as part of a merger or sale of assets.


14. Changes and Amendments

We may update this Agreement at any time. Continued use of the Services constitutes acceptance of the updated terms.


15. Acceptance of These Terms

By using the Website or Services, you agree to be bound by this Agreement.


16. Service Suspension Rules, Malicious Activities & Other Policies

1. Payment Suspensions

  • Invoices are issued 10 days before the due date.

  • Services are suspended immediately after the due date if unpaid.

  • Late fees apply beginning 1 day after the due date.

  • Suspended services are permanently deleted after 5 days, including backups (which cannot be recovered).

  • Accounts with no active services are automatically deleted after 120 days.

Payment Fraud Prevention

  • We use multiple fraud detection mechanisms such as pattern analysis, geolocation mismatch checks, and behavioral indicators.

  • Account information must be accurate and up-to-date.

  • Payments made using VPNs or proxies may be flagged or rejected.


2. Policy on Malicious Activities (Including DDoS Attacks)

We enforce a zero-tolerance policy for:

  • DDoS attacks

  • Port scanning

  • Unauthorized access attempts

  • Any activity that harms our infrastructure or other customers

If detected:

  • You will be notified

  • The service will be immediately suspended

  • No refunds will be issued


3. Crypto Mining & Node Hosting Policy

  • Crypto mining and node hosting are allowed under controlled usage.

  • CPU usage must remain below 75% across all cores.

  • Sustained CPU usage above 100% may cause performance degradation.

  • If CPU usage exceeds 75% for more than 24 hours, you will be notified.

  • Continued excessive usage may result in throttling or resource limits.

  • Repeated abuse may result in account termination without refund.


4. Gateway Security & Storage IO Policy

4.1 Gateway Abuse

  • Probing or scanning the gateway is strictly prohibited.

  • Violations trigger temporary IP blocks ranging from minutes to days.

  • Repeated or severe violations may result in immediate service termination without refund.

4.2 Storage IO Abuse

  • Using 100% of allocated IO bandwidth for more than 8 consecutive hours is considered abuse.

Actions Taken:

  • 1st violation: 24-hour suspension

  • 2nd violation: 3-day suspension

  • 3rd violation: Permanent termination (no refund)

Customer Responsibilities:

  • Monitor resource usage

  • Implement limits or automation where appropriate


17. Service Transfers – Terms & Conditions

We support service transfers between customers under strict conditions. Only eligible services may be transferred to a new owner, and a processing fee applies.

The transfer fee must be paid by the new owner.

Eligibility

  • Only List-Priced Products may be transferred.

  • Promotional, discounted, or special-offer services are non-transferable.

  • Promotional services with custom upgrades are permanently locked to the original account.
    This includes:

    • One-time CPU/RAM/disk upgrades

    • Any consolidation, stacking, or merging of services

  • Services with one-time upgrades (even if not promotional) are permanently tied to the purchaser. If transferred, all one-time bonuses are forfeited.


How the Transfer Process Works

  1. The current owner opens a support ticket with the new owner’s email address.

  2. We confirm which service is being transferred (if multiple exist).

  3. A Transfer Fee invoice is issued to the new owner.

  4. Once paid, a confirmation request is sent to both parties.

  5. After both confirm, the transfer is completed.

  6. Typical completion time: within 24 hours, subject to support workload.


Account Requirements

  • The sender’s account must be at least 30 days old.

  • Accounts created for buying/reselling/transferring services—especially in bulk—are considered fraudulent.

Examples include:

  • Mass purchasing discounted services for resale

  • Frequent transfers without actual use

Violations result in:

  • Immediate termination of all involved accounts

  • Permanent loss of all services without refund


Fraud Prevention and Enforcement

Fraud includes any attempt to circumvent the transfer process, such as:

  • Changing account emails repeatedly to avoid transfer fees

  • Purchasing on behalf of banned individuals

  • Creating temporary accounts for mass purchasing

Penalties:

  • All related accounts suspended

  • Services set to auto-terminate at the billing cycle end

  • No renewals or reactivations allowed


18. Service Upgrade Rules

Customers with multiple services may request custom consolidations or upgrades according to the rules below.


Definitions

Promo VPS

A VPS that are in the “PROMO” category of products.

List-Priced Products

A VPS or service that:

  • Does not contain “PROMO” in the title, and

  • Is sold at standard catalog pricing or purchased using a discount code

List-priced products retain full upgrade and transfer eligibility unless modified by promotional upgrades.


General Guidelines

  • Upgrades may only occur between services of the same product category (CPU, RAM, NVMe, Addon Drive, IPv4, Traffic).

  • Customers may upgrade from a lower-tier VPS to a higher-tier List-Priced VPS at any time, subject to availability.


Promo VPS Services

  • Promo VPS services cannot be stacked or combined.

  • Remaining contract value may be converted into account credit, usable only toward:

    • List-Priced Products

    • Upgrades of List-Priced services

  • Promo VPS credit cannot be used toward other promotional services.

  • Promo VPS services are always non-transferable.

  • Upgrades from List-Priced → Promo VPS are strictly prohibited.


List-Priced VPS Services

  • Customers may combine any four main resource categories:
    CPU, RAM, NVMe, Addon Drive, IPv4, Traffic.

  • Combined services remain transferable unless promotional upgrades are later added.


Account Credit From Unused Services

Customers may request conversion of remaining contract value into account credit.

Credit may be used to:

  • Upgrade services

  • Purchase new services

  • Pay invoices

Refund Rules:

  • If credit exceeds $5 USD, it may be returned to the original payment method
    Customer pays all transaction fees

  • If the original gateway is unavailable, credit remains non-cash

  • Refunds cannot go to alternate payment methods


19. Standard Refund Window

Refunds follow these rules:

  • Only List-Priced Products are eligible for cash refunds.

  • Promotional services may be refunded as account credit only.

  • Refunds available within 48 hours of purchase (no-questions-asked).

  • Refunds are issued only to the original payment method.

  • Services purchased using account credit are refundable only as credit.

Refund Exceptions

No refunds for:

  • Service misuse

  • TOS violations (“hit and run,” abuse, etc.)

  • Fraud or attempts to circumvent policy

Credit Option

Remaining value of active services may be converted into account credit.

Credit can be used to:

  • Purchase any product

  • Participate in sales (while inventory lasts)

  • Switch products within the same sales channel

Important Notes:

  • Account credit does not override promo restrictions

  • If account credit exceeds $5, customer may request return to the original payment method
    → Customer pays all payment gateway fees

  • Refunds cannot be issued to alternative payment methods
